Distance Sales Agreement

1. Parties

SELLER (Travel Agency):

BUYER (Consumer):

The natural or legal person making the reservation through the website. Identity and contact information is recorded as part of the reservation process.

2. Subject of the Agreement

This agreement governs the rights and obligations of the parties regarding the sale and delivery of tourism services (hotel accommodation, tour, car rental, yacht charter, and package tour services) ordered by the BUYER through the SELLER's website (dailytoursturkiye.com), in accordance with the Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

3. Service Information

Details of the purchased service (type, date, duration, price, number of participants, and other features) are as specified in the reservation summary presented to the BUYER before payment and sent via confirmation email.

4. Price and Payment

  • All prices shown on the website include VAT unless otherwise stated.
  • The total price is stated in the reservation summary prior to confirmation.
  • Payment is made via credit/debit card or other payment methods available on the website.
  • The SELLER reserves the right to change prices for services not yet confirmed.
  • Exchange rate differences may affect the final price for services priced in foreign currency.

5. Service Delivery

Services are delivered at the date, time, and location specified in the reservation. The BUYER is responsible for being present at the specified location at the specified time. A reservation confirmation notification is sent to the BUYER via email.

6. Right of Withdrawal

In accordance with Article 15 of the Distance Contracts Regulation, the right of withdrawal DOES NOT APPLY to the following tourism services:

  • Accommodation services to be performed on a specific date or period
  • Transportation services to be performed on a specific date or period
  • Food and beverage services to be performed on a specific date or period
  • Leisure activities to be performed on a specific date or period

For package tour services, special regulations apply. Tour participants may cancel the contract up to 30 days before the start date without any deduction.

7. Obligations and Responsibilities

SELLER's Obligations:

  • To deliver the service in accordance with the agreement and in a complete and timely manner
  • To inform the BUYER about any material changes to the service
  • To protect the BUYER's personal data in accordance with KVKK
  • To process refunds within the specified period in case of cancellation

BUYER's Obligations:

  • To provide accurate and complete information during the reservation
  • To make payment on time and in full
  • To be present at the service delivery point at the specified time
  • To carry valid identity documents and other required documents

8. Force Majeure

In cases of force majeure (natural disasters, epidemics, war, legal prohibitions, etc.), the SELLER may cancel or postpone the service. In such cases, the BUYER is offered a full refund or an alternative date/service.

9. Dispute Resolution

  • Consumer Arbitration Committees are authorized for disputes up to the monetary limit determined by the Ministry of Trade.
  • Consumer Courts are authorized for disputes above this limit.
  • Mandatory mediation applies to consumer disputes. Court proceedings cannot be initiated without first applying for mediation.

Additionally, complaints may be submitted to TURSAB Ethics Committee.

10. Agreement Acceptance

The BUYER, by confirming the reservation, declares that they have read, understood, and accepted all terms of this agreement.
